Note, Alvarez fought the DNA testing for two additional years (he spent 17 years behind jail) that ultimately exonerated Mr. Nash.  But for an Appellate Court Judge ordering the test, an innocent man would still be in jail. In light of the DNA testing, Alvarez knew that the evidence introduced at the original trial would be insufficient to convict Mr. Nash and that is why she dropped the charges-but only after he spent an additional two years in jail.
